The number one copyrighters try to shut down authorised Prabhupada site for copyright!
 

Recently there has been an attempt to shut down the site PRABHUPADA YOUR EVER WELL WISHER by the number one copyrighters the bbti. Of course this simply reveals that they are feeling the heat of my exposing their rascal book changing etc. [See  ARE YOU A SUPPORTER OF SISUPALA ISKCON and "STICK TO THE SOCIETY" ANOTHER OFFENSIVE MAD ELEPHANT BOOK CHANGE] and cannot tolerate Prabhupada's glorification as found in books like his authorised autobiography.

The letters exchanged between myself and my web site host and theirs with the bbti can be seen below. [given in order of latest down to first correspondence]:

 
Dear 1&1 thank you for your message.
 
I have today spoken to Alex Woodrow [Supervisor for technical support] of your UK branch and he has told me to inform you of the content of our conversation.
 
 The claim made against me of copyright is unfounded as the group making these charges [bbti] holds no ownership of copyright of the books etc. of His Divine Grace A.C. Bhaktivedanta Swami Prabhupada. 
 
On my web site I have tried to inform the public by quoting from the original writings of His Divine Grace A.C. Bhaktivedanta Swami Prabhupada about the totally corrupt and immoral activities [murder of the author, unauthorised changing of his writings and message, child molestation etc….] of this bbti cult and it’s various sub branches. Thus their complaint to you is a personal vendetta against me in an attempt to silence my whistle blowing by shutting down my site. 
 
Alex Woodrow has said that 1&1 will follow it’s standard policy and take no action against me unless it can be legally proved that the bbti actually own the copyright and that my site is in violation of such said copyright.

Copyright - What it is and why it is important
 
 There are also three conditions attached to copyright, and these must be met before the material is protected by law:
  1. It must be original - it must not have been copied from something that already exists  
  2. It must be in material form - which means in practice a form from which it can be reproduced or copied  
  3. 3. The author must be a qualified person - a British subject or someone who normally lives or is domiciled here, or the material must first be published in this country (2)  
So point 1. is very intersting! The bbti print changed books, copies of Prabhupada original books so they have no copyright ownership. Prabhupada's original books exist and they have copied them. So they are the original violators of copyright law. JUST SEE!!!

Also point 3 could be looked at.

 
 
Infringement of Copyright
 
 An infringement of copyright is when a person carries out a restricted act without permission. Restricted acts are:
  • Copying material  
  • Issuing copies to the public  
  • Showing, playing or broadcasting or filming  
  • Adapting or amending material  
 
Only the Copyright owner is legally allowed to perform the above or give permission for someone else to perform a restricted act. Thus if you wish to do any of the above then you must gain permission from the Copyright owner. This ensures protection of the commercial interests which belong to the Copyright owner.

Adapting or amending material [changing Prabhupada books] is Infringement of Copyright! Only Prabhupada the author and copyright owner is legally allowed to amend any of his writings. He ordered that no changes should be made to his writings and that all his books should be printed in the original format, approved and authorised by him.

 
Yasoda-nandana [disciple]: Sometimes they appeal that "We can make better English," so they change like that, just like in the case of Isopanisad. There are over a hundred changes. So where is the need? Your words are sufficient. The potency is there. When they change, it is something else.
Svarupa Damodara[disciple]: That's actually a very dangerous mentality.
Yasoda-nandana [disciple]: What is it going to be in five years? It's going to be a different book.
Prabhupada: So you... What you are going... It is very serious situation. You write one letter that "Why you have made so many changes?" And whom to write? Who will care? All rascals are there. Write to Satsvarupa that "This is the position. They are doing anything and everything at their whim." The next printing should be again to the original way…They cannot change anything.

Moral Rights
 
 As well as Copyright, a creator also has Moral Rights attached to any materials created. Moral rights are different from Copyright, but are just as important, and last for as long as Copyright. Moral Rights are:
  1. The right to be identified as the author or creator (paternity right) - this applies to literary and artistic works.  
  2. The right to object to your name being attributed to something you did not create - this is to stop potential damage to your reputation. For example a tabloid newspaper may "quote" from a person, but it is not actually a real quote. This is like libel  
  3. The right to object to derogatory treatment of your work - this is very important in digital imaging, where cropping, colour manipulation, adding features are very easy processes in software packages.  
 
Moral rights can not be assigned, even if the copyright has been, they remain with the creator. However the owner may wish to waive their moral rights and this is a unique feature to the UK Law. If a person wishes to copy a work it is important that they gain Copyright clearance but also moral rights clearance as well. Moral rights do not apply to some types of materials, such as employee created materials or journal articles.
 

Prabhupada has already protested against their book changing [see above] which is derogatory treatment of his work and is having his name being attributed to something he did not create - i.e. bogus philosophy,  this is to stop potential damage to his reputation and the future of his mission.

He also formed his trust [B.B.T. –Bhaktivedanta Book Trust] for exclusive publication of his books. 

 

So far my books are concerned, I am setting up a different body of management known as the BHAKTIVEDANTA BOOK TRUST. The trustees of this body are also members of the GBC, but their function is not dependent on the GBC. ISKCON Press was created for the exclusive publication of my books and literatures and should be continued in that way.

The bbti group as well as bootlegging original Prabhupada writings mixed with their unauthorised amendments, publish many books by many other authors this also violates Prabhupada moral rights!
